Scout & Aerial, L.L.C. ("Scout & Aerial," "we," "us") provides media, measurement, property-documentation, utility-summary, limited lockbox/sign coordination, limited labor services, tech services, and web-based software tools, including Scout & Aerial Costs.

1) What we do

Scout & Aerial provides marketing media, measurements, Scout Reports, utility-availability summaries, related listing/property documentation, technology support, and business workflow tools. Listing and property deliverables are not a home inspection, appraisal, land survey, engineering report, or legal opinion.

2) Scout & Aerial Costs and software tools

Scout & Aerial Costs is a restaurant costing, inventory, menu-costing, labor-costing, sales-trend, and decision-support tool. It is intended to help users organize business information and understand possible cost, sales, inventory, and labor patterns.

Scout & Aerial Costs does not provide accounting, tax, legal, financial, employment, food-safety, payroll, regulatory, or business-investment advice. Any numbers, targets, trends, recommendations, forecasts, or scenario outputs are informational estimates based on the data entered or imported by the user. You are responsible for reviewing all outputs before relying on them and for consulting qualified professionals when appropriate.

Software tools may change over time. We may add, remove, rename, improve, limit, or discontinue features as the tool develops, including features related to imports, backups, Google Drive sync, reports, graphs, menu costing, inventory, OCR/scanned invoice processing, or scenario planning.

3) Accounts, Google sign-in, Drive sync, and manual filing

Some Scout & Aerial tools may require or offer account access, including Google sign-in. If you choose to sign in with Google, you authorize the app to receive limited Google account information, such as your name, email address, profile image, and account identifier, as described in our Privacy Policy.

Google Drive sync, if offered, is optional. If you connect Google Drive, the app may create, find, read, and update Scout & Aerial Costs files that the app creates or that you select for use with the app. Those files are stored in your Google Drive account, not in a Scout & Aerial-owned Drive. You are responsible for your Google account, Drive sharing settings, and Drive file retention.

Manual filing may also be offered. If you download, move, rename, delete, share, or store files outside the app, those copies are controlled by you. Scout & Aerial cannot recover, view, edit, verify, or replace manual copies that are only stored by you or in storage locations we cannot access.

You may disconnect Drive sync in the app when available, and you may revoke the app's Google access through your Google Account permissions. Disconnecting, deleting, renaming, moving, or revoking access to files may affect the app's ability to save, load, restore, or verify those files.

4) User records, backups, and account security

You are responsible for keeping any records required for your business, taxes, accounting, employment records, inventory controls, food-cost records, or other compliance needs. Scout & Aerial Costs is not a substitute for your own recordkeeping obligations.

You are responsible for protecting your login credentials, devices, downloaded files, Google account, Google Drive folders, shared links, and backup copies. We recommend using a business Google account where practical, enabling Google 2-Step Verification or passkeys, reviewing sharing permissions, and keeping periodic local backups.

We may provide backup reminders, export tools, Drive sync tools, restore tools, or import tools, but we do not guarantee that any backup, sync, import, export, or restore process will be uninterrupted, error-free, complete, or recoverable in every situation.

5) User content and acceptable use

You retain ownership of business records, files, menu data, inventory data, cost data, sales data, labor data, notes, and other content you enter, upload, import, or store through Scout & Aerial tools. You grant Scout & Aerial the limited permission needed to operate, maintain, secure, troubleshoot, and improve the tools and to provide support you request.

You agree not to use Scout & Aerial tools to upload malware, unlawful content, highly sensitive personal information that is not needed for the tool, or content you do not have the right to use. You are responsible for confirming that any uploaded, imported, scanned, or manually entered information is lawful, accurate, and appropriate for your use.

6) Booking, deposits, and cancellations

No deposit is required unless the travel fee shown on the estimate is $50 or greater, or unless otherwise agreed in writing. If required, that deposit constitutes the travel fee due at booking to reserve the appointment and is credited toward the final invoice.

Deposits, scheduling, late-cancellation terms, travel charges, and refund terms are described in our Policies & FAQs and on applicable estimates/invoices.

Summary: The deposit is fully refundable if cancellation or rescheduling occurs with at least 24 hours' notice before the scheduled arrival window and Scout & Aerial has not begun work or travel, less any non-refundable third-party costs already incurred. With less than 24 hours' notice, for jobs where the deposit is the full travel fee, the deposit will be refunded less the miles actually driven round trip.
 
Scout & Aerial will not charge more in late-cancellation fees and mileage than the amount of the deposit and does not issue a separate invoice solely for cancellation fees.

7) Payment and travel

Unless otherwise agreed in writing, invoices are issued with Net 10 terms, meaning payment is due 10 calendar days after the invoice date.

Standard travel: Travel is calculated from one-way distance from Whitsett, NC 27377. Up to 60 one-way miles is included at no charge. Beyond 60 one-way miles, travel is billed at $0.70 per mile, rounded down to the nearest whole dollar, with no charge under $5.

Lockbox & Sign pickup/install: This service is priced separately at a $50 minimum, then $0.70/mi one way from Whitsett when mileage pricing exceeds the minimum, including the entered stops for that service route.

A $25 administrative late fee may be assessed on day 11 for unpaid balances. Beginning day 31, a finance charge of 0.67% per month, 8% APR equivalent, may be applied to past-due balances, as permitted by North Carolina law. Returned payments, including NSF or failed ACH payments, may incur a $35 processing fee per item. ACH is preferred; card payments may incur processor-imposed fees. We may suspend services and withhold deliverables on past-due accounts and may seek allowable collection costs and attorney's fees as permitted by law.

8) Site readiness and safety

You are responsible for ensuring lawful access, safe conditions, and that the site is ready for the agreed services. No-show, after-departure cancellation, or site-not-ready situations may result in fees as described above. Scout & Aerial may postpone, reschedule, or modify services for weather, unsafe conditions, legal compliance, or airspace restrictions, including FAA Part 107 requirements.

9) License to use media and reports

Upon full payment, Scout & Aerial grants the hiring party a non-exclusive, limited license to use delivered media and reports to market or otherwise support the subject property or assignment for its intended purpose. Reuse outside that scope requires prior written permission. Scout & Aerial retains copyright unless otherwise agreed in writing.

10) Measurements, reports, and client responsibility

Measurements follow NCREC rules and ANSI Z765 when applicable. Site/land figures, boundary illustrations, utility summaries, Scout Reports, and other documentation are professional tools intended to assist with marketing and disclosure support; they are not guarantees and are not for permitting, engineering, appraisal, or survey use.

All measurements, floor plans, media, and reports provided by Scout & Aerial must be reviewed for accuracy and suitability before they are used in MLS entries, marketing, disclosures, contracts, due diligence decisions, or client communications. Utility availability, provider serviceability, fees, schedules, and account eligibility must be verified directly with the relevant provider or jurisdiction before reliance.

  • As the hiring party, agent, or broker, you remain responsible for compliance with NCREC rules, MLS guidelines, local requirements, and brokerage policies.
  • You remain responsible for how information from our deliverables is interpreted, edited, or published.
  • You remain responsible for any representations made to buyers, sellers, landlords, tenants, or third parties.
  • You remain responsible for obtaining any required permissions to access property, fly, photograph, install/remove lockboxes or signs, or perform related services.

11) Tech services and labor services

Tech services include a complimentary consult call before paid work begins. Paid tech work starts at 90 minutes for the base fee shown on the booking page, with additional time billed at the then-current hourly rate shown there. Labor services are offered for smaller-scope work on a case-by-case basis and may be declined if Scout & Aerial determines that a more appropriate service provider should be engaged. Larger, recurring, or out-of-scope requests may require a separate agreement.

12) Third-party services

Scout & Aerial tools may rely on third-party services, including Google, Cloudflare, payment processors, mapping providers, analytics providers, hosting providers, and other vendors. Third-party services are subject to their own terms, privacy policies, outages, limits, pricing, and account requirements. We are not responsible for third-party service failures, changes, suspensions, deletions, permission changes, or account issues outside our reasonable control.

13) Changes, reshoots, and additional services

Changes outside the original scope, return trips, additional stops, client-requested reshoots, added research, added documentation, software configuration, additional imports, custom reporting, custom workflows, training, or other scope changes may be billed at standard rates plus applicable travel.

14) Disclaimers

Services and software tools are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and error-free operation.

Scout & Aerial does not guarantee that any cost percentage, labor percentage, sales target, inventory value, menu costing result, scanned invoice result, OCR result, recommendation, forecast, import, export, backup, restore, or sync result will be accurate, complete, timely, or suitable for a particular business decision. You are responsible for reviewing and validating outputs before relying on them.

15) Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to services, deliverables, software tools, accounts, data, files, sync, backups, imports, exports, or support is limited to the amount you paid Scout & Aerial for the specific job, subscription period, or service giving rise to the claim. If no amount was paid for the specific tool or period at issue, our liability is limited to $100.

We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost business opportunities, business interruption, lost data, corrupted data, failed backups, failed sync, deleted files, inaccurate inputs, inaccurate outputs, or decisions made using the tools.

16) Indemnity

You agree to indemnify and hold Scout & Aerial harmless from claims arising out of misuse of deliverables or software tools, inaccurate or unlawful data you provide, failure to obtain required permissions, publication of inaccurate or unverified information, business decisions made using tool outputs, violation of applicable law, or violation of these Terms.

17) Governing law

These Terms are governed by the laws of the State of North Carolina. Venue is proper in state or federal courts located in North Carolina.

18) Changes to these Terms

Scout & Aerial may update these Terms by posting a revised version at this URL with a new effective date. Material changes may be highlighted on the page or elsewhere on the site.
