Scout & Aerial, L.L.C. (“Scout & Aerial,” “we,” “us”) provides media, measurement, and property-documentation services across the NC Triad.
1) What we do
We deliver marketing media and documentation for real-estate listings. Deliverables are not a home inspection, appraisal, or land survey.
2) Booking, deposits, and cancellations
A deposit required at booking to reserve the time slot.
Deposit = Travel Fees $50 or greater are due upfront as a Deposit
Deposit is applied to your final invoice. Deposits, scheduling, late-cancellation fees, travel charges, and refund terms are described in our Policies & FAQs and on estimates/invoices.
3) Payment
Unless otherwise agreed in writing, invoices are issued with Net 10 terms (payment due 10 calendar days after the invoice date). Each appointment includes the first 30 round-trip miles from Whitsett, NC 27377 at no charge; additional distance is billed at $0.70 per mile (round trip).
A $25 administrative late fee may be assessed on day 11 for unpaid balances. Beginning day 31, a finance charge of 0.67% per month (8% APR equivalent) may be applied to past-due balances, as permitted by North Carolina law. Returned payments (NSF/ACH) may incur a $35 processing fee per item. ACH is preferred; card payments may incur processor-imposed fees. We may suspend services and withhold deliverables on past-due accounts and may seek allowable collection costs and attorney’s fees as permitted by law.
4) Site readiness and safety
You ensure lawful access and that the site is photo-ready. No-show, after-departure cancellation, or site-not-ready may incur fees as stated above. We may postpone or modify services for weather/airspace (Part 107), unsafe conditions, or legal compliance.
5) License to use media
Upon full payment, we grant the hiring party a non-exclusive, limited license to use delivered media to market the subject property during its active listing. Reuse outside that scope requires written permission. We retain copyright unless otherwise agreed.
6) Measurements, reports, and agent responsibility
Measurements follow NCREC rules; ANSI Z765 when applicable. Any site/land figures are marketing approximations and are not for permitting, appraisal, or engineering use.
All measurements, floor plans, media, and reports we provide are professional tools to assist with marketing and disclosure. They do not replace your duties as a licensed real estate professional. You agree to review all deliverables for accuracy and suitability before using them in any MLS entry, marketing, disclosure, or client communication.
- As the agent/broker, you remain solely responsible for:
- Compliance with NCREC rules, MLS guidelines, and your brokerage policies
- How information from our deliverables is interpreted, edited, or published
- Any representations you make to buyers, sellers, or third parties
- These services do not make Scout & Aerial the listing agent of record and do not shift your statutory or fiduciary duties to us; they help you meet those duties.
7) Changes, reshoots, and additional services
Changes outside the original scope, return trips, or client-requested reshoots may be billed at standard rates plus travel.
8) Disclaimers
Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.
9) Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the services is limited to the amount you paid for the specific job giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.
10) Indemnity
You agree to indemnify and hold Scout & Aerial harmless from claims arising out of your misuse of deliverables, failure to obtain required permissions, or violation of law.
11) Governing law
These Terms are governed by the laws of the State of North Carolina. Venue is proper in state or federal courts located in North Carolina.
12) Changes to these Terms
We may update these Terms by posting a revised version at this URL with a new effective date. Material changes will be noted on the page.
